These Terms & Conditions govern the purchase of products through the RAW BERRY PRESS online store.
By placing an order through our website, you agree to these Terms & Conditions. Nothing in these Terms & Conditions limits or excludes any right you may have under applicable South African law, including the Consumer Protection Act 68 of 2008 (“CPA”).

2. Products
We manufacture and sell cold-pressed juice and related products.
Our products are made from natural ingredients and are manufactured, bottled and frozen at our production facility.
Product descriptions, ingredients, nutritional information, pack sizes and other product information are provided on the website and/or product packaging.
Natural products may vary slightly in colour, flavour, texture and appearance from batch to batch. Such natural variation does not necessarily constitute a defect.
3. Product information and food allergies
Customers are responsible for reviewing the product ingredients and allergen information before ordering.
If you have a food allergy, intolerance or other dietary restriction, please contact us before placing an order if you require clarification regarding ingredients or potential cross-contamination.
4. Prices
All prices displayed on the website are in South African Rand (ZAR) and include VAT where applicable.
We reserve the right to change prices at any time, but any price change will not affect an order that has already been accepted and paid for.
Delivery charges, where applicable, will be displayed before the customer completes the purchase.
5. Placing an order
An order is placed when the customer completes the online checkout process and payment has been successfully received or authorised.
We reserve the right to decline or cancel an order where:
• payment cannot be verified;
• the requested delivery address falls outside our delivery area;
• a product is unavailable;
• there is an obvious pricing or product-description error; or
• circumstances outside our reasonable control prevent fulfilment.
If we cancel an order after payment has been received, the applicable amount paid for the cancelled order will be refunded.
6. Payment
Payment is processed through the payment methods made available on the website.
We do not retain customers’ full payment-card details.
An order will normally only be processed once payment has been successfully authorised.
7. Delivery
Our products are frozen before dispatch and transported in insulated packaging designed to maintain the required temperature during transit.
Delivery is made to the address supplied by the customer at checkout.
Because our products are perishable food products, customers must ensure that someone is available to receive the delivery.

8. Delivery risk
We remain responsible for the goods until delivery to the customer, subject to the customer’s obligations to provide a correct delivery address and to be reasonably available to receive the order.
Customers must inspect the delivery as soon as reasonably possible after receipt and notify us promptly of any problem with the order.
9. Frozen products
Our products are dispatched frozen.
On receipt, the customer should immediately transfer the products to a suitable freezer or fridge unless the product packaging specifically states otherwise.
Customers should follow all storage and use instructions appearing on the product packaging.
A product that has thawed during delivery must not automatically be regarded as defective. The appropriate action depends on the condition and temperature of the product on arrival and the applicable food-safety requirements. Our products have an independently verified 150 day shelf life in the fridge.
Customers should contact us immediately if a product arrives, warm, damaged or otherwise appears unsafe or unsuitable for consumption.
10. Cancellations, returns and refunds
Because our products are perishable food products, we cannot ordinarily accept the physical return of products merely because a customer has changed their mind after dispatch.
This does not affect any statutory consumer rights that apply to the transaction, including rights relating to defective, unsafe, unsuitable or incorrectly supplied goods.

11. Damaged, incorrect or defective products
If an order arrives damaged, contains the wrong products, is incomplete, or a product appears defective or unsafe, the customer should contact us as soon as possible.
Where appropriate, we may request photographs of:
• the external packaging;
• the insulated container;
• the product packaging;
• the product itself;
• the batch/lot number; and
• any visible damage or evidence of thawing.
This information assists us in investigating delivery and product-quality issues.
Where a statutory remedy applies, we will provide the remedy required by applicable law.
12. Product shelf life
The applicable use-by, best-before or other date information is stated on the product packaging.
Customers must observe the storage instructions and relevant date markings.
Once a product has been delivered, the customer is responsible for storing it in accordance with the instructions supplied with the product.
13. Delivery addresses
Customers are responsible for providing an accurate and complete delivery address, including:
• street address;
• suburb/town;
• postal code;
• contact telephone number;
e-mail address; and
• any relevant access or delivery instructions.
We are not responsible for delays or failed deliveries caused by an incorrect or incomplete address supplied by the customer.
Where a second delivery attempt or redirection results in an additional courier charge, that charge may be payable by the customer, subject to applicable law.
14. Promotional codes and discounts
Promotional codes must be used in accordance with the terms applicable to the promotion.
Unless expressly stated otherwise, promotional codes cannot be exchanged for cash and cannot be applied retrospectively to previous orders.
15. Website content
We make reasonable efforts to ensure that information on the website is accurate and current.
However, minor errors, omissions or technical inaccuracies may occasionally occur.
We reserve the right to correct errors and update website content where necessary.
16. Intellectual property
All website content, including photographs, text, logos, graphics, product descriptions and other material, is owned by or licensed to us and may not be reproduced or used commercially without our prior written permission.
17. Privacy
Personal information supplied by customers will be handled in accordance with our Privacy Policy and applicable South African privacy legislation.
18. Limitation of liability
Nothing in these Terms & Conditions excludes or limits any liability or consumer right that cannot lawfully be excluded or limited under South African law.
Subject to the foregoing, we will not be responsible for loss arising from circumstances outside our reasonable control, including courier disruptions, extreme weather, natural disasters, strikes, road closures, power failures, or other events beyond our reasonable control.

20. Governing law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with in accordance with applicable South African law and the consumer’s rights under that law.
21. Changes to these Terms & Conditions
We may update these Terms & Conditions from time to time.
The version applicable to an order will be the version in force when the order was placed.
